CNC PRO OWNER SERVICE LEVEL AGREEMENT (SLA)
Owners are defined as any current or past owners of the CNC Pro patented by and for Red Art Technologies LLC and/or Henry Ashworth. Red Art Technologies LLC warranties the CNC Pro for 1 year after purchase. This covers all manufacturer defects on the following non-wearable components:
- Rails
- Gantry
- Computer
- Software
- Case
RMA (return merchandise authorization) must be obtained during the warranty coverage period. Owner must first contact Red Art Technologies at support@redarttechnologies.com and attempt repair in-house; And follow provided tutorials and troubleshooting steps. Return shipping is to be paid by the Owner. Owner is responsible shipping insurance. If it is determined to be a manufacture defect, shipping and repair of the unit will be covered by Red Art Technologies LLC. The product will either be repaired or replaced with a comparable unit.
SAFETY
Owners assume full responsibility for safe handling and use of the CNC Pro and its components. Furthermore, Owners will not hold Red Art Technologies LLC, its Agents, Officers or fellow Owners responsible for any damages resulting from user-error or unsafe handling.
DIGITAL CONTENT
No warranties on digital content.
All digital content, including Redarttechnologies.com, Redarttech.com, the Facebook CNC Pro Owner’s Group, and any Red Art Technologies LLC managed social media will be referred to as: Digital Content. Digital Content is provided “as is” without any representations or warranties, express or implied. Red Art Technologies LLC makes no representations or warranties in relation to the Digital Content, or the information and materials provided therein.
Without prejudice to the generality of the foregoing paragraph, Red Art Technologies LLC does not warrant that:
the Digital Content will be constantly available, or available at all; or the information contained therein is complete, true, accurate or non-misleading.
Nothing published within Digital Content is meant to constitute, advice of any kind. Red Art Technologies LLC is not a legal or tax preparation service.
Limitations of liability
Red Art Technologies LLC will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, Digital Content:
for any direct loss; for any indirect, special or consequential loss; or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data. These limitations of liability apply even if Red Art Technologies LLC has been expressly advised of the potential loss.
Exceptions
Nothing in this agreement will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Red Art Technologies LLC liability in respect of any:
fraud or fraudulent misrepresentation on the part of Red Art Technologies LLC; or matter which it would be illegal or unlawful for Red Art Technologies LLC to exclude or limit, or to attempt or purport to exclude or limit, its liability.
Reasonableness
By using Digital Content, you agree that the exclusions and limitations of liability set out in this disclaimer are reasonable. If you do not think they are reasonable, you must not use Digital Content.
AUP (ACCEPTABLE USE POLICY)
Owner agrees to only utilize the bidding sheet, multimedia and any shared content on the above channels within their intended scope.
NON-DISCLOSURE AND DEFAMATION
Owner agrees to the following NDA (non-disclosure agreement). NDA includes (IP) intellectual property made available by Red Art Technologies LLC to Owners via, but not limited to, the following channels:
- Owner’s Portal located on the RedArtTechnologies.com website
- CNC Pro Owner’s Facebook Group
- Communicated verbally
Unless labeled “for marketing purposes”, User agrees not to disclose IP as listed in the channels listed above. Publicly available website and social media content, that is produced by Red Art Technologies, may only be used in business marketing promotions.
Reviews and Anti-defamation
Owner and Red Art Technologies agree to never leave any negative review or disparaging remarks that may discourage any prospective customer from making a purchase or using services from either party. The offending party will be liable for any loss of income.
DEPOSITS & PROMOTIONS
Unless agreed to in writing deposits are nonrefundable and entitle the User to a CNC Pro Concrete Engraving Machine within 6 months after deposit is received once full payment is made. If the remaining balance is not paid within 6 months, the deposit is forfeited. Any temporary promotions are only valid with FULL PAYMENT during the time the promotion is active. Deposits do not entitle the User to the promotional price unless otherwise agreed to in writing.
SHIPPING
User is responsible for purchasing shipping insurance.
Other parties
You accept that, as a limited liability entity, Red Art Technologies has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against Red Art Technologies LLC officers or employees in respect of any losses you suffer in connection with the Digital Content.
Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this Digital Content disclaimer will protect Red Art Technologies LLC officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Red Art Technologies LLC.
